clearTXT and their affiliates (collectively "clearTXT") are committed to protecting the privacy of its users. Because clearTXT gathers certain types of information about users of the services provided by clearTXT ("Services"), we believe you should fully understand the terms and conditions surrounding the use of the information we collect.
The following discloses our information gathering and dissemination practices for the clearTXT website and clearTXT services integrated with e-Learning systems installed at schools (e.g., clearTXT integrated with the Blackboard Learning System installed at schools); the practices relating to persons with separate agreements with clearTXT or its affiliates are separately covered in those agreements.
Please review the following statement to understand how the information you provide to clearTXT is treated.
1. Information clearTXT collects.
You are free to visit clearTXT.com without identifying yourself; however, if you would like to utilize the Services, you must first register with clearTXT. When you register, we will request certain personal information, including but not limited to, your name, city and state, e-mail address, cell phone number (so that you may opt-in to receive SMS notifications), and age. Some of this information may be “pre-populated” in the registration form if users access clearTXT through a school. This information better enables us to provide users with notifications relevant to their interests and the courses in which they are registered, and provides us with aggregate demographic data that clearTXT uses to improve the services offered to users. This information can be updated, corrected, or modified at any time by selecting the "My Account" option throughout the Service.
In addition to registration, clearTXT may, from time to time, request personal information for purposes such as the provision of customer service, billing, network management, customer surveys, newsletter subscriptions, offers of related services, and other exchanges of information. Users may opt-out of receiving future promotional mailings at any time.
2. What clearTXT does with the information it collects.
The personal information you supply to clearTXT will not be given, sold, rented, loaned, or otherwise disclosed to any third parties, except when we have your permission or under special circumstances, such as when we believe in good faith that disclosure is reasonably necessary to (i) comply with legal process, (ii) enforce the Terms of Use, (iii) respond to claims that any content on any clearTXT Services violates the rights of third parties, or (iv) protect the rights, property, or personal safety of clearTXT, its users, or the public.
clearTXT uses aggregated personal information to determine the demographics of our users and to distribute statistics and general marketplace information about clearTXT, and to provide partners accurate information about users requesting their services. These demographics will always represent aggregate information and will never identify specific users.
clearTXT may disclose aggregated user statistics in order to describe the service to prospective partners, advertisers, and other third parties, and for other lawful purposes. Schools, partners, advertisers or Web sites that are linked to clearTXT online services may collect personally identifiable information about users. The information practices of those entities are not covered by this Privacy Policy and clearTXT is not responsible for the privacy practices or the content of such Web sites.
3. User Options – Opt-In/Opt-Out
The Services of clearTXT are completely opt-in. Users must opt-in (give permission) to receive notifications from senders. Users may opt-out at any time in order to stop receiving notifications from clearTXT and their partners. clearTXT reserves the right to send users email related to business practices and systems operations, such as outage notifications and quota warnings, even if the user has opted out of promotional mailings.
4. Access to Your Information
clearTXT offers users the ability to correct or change the information collected during registration. Users may change this information at any time and as often as necessary by choosing the "My Account" option offered throughout the Service.
5. Security
clearTXT takes security seriously and takes reasonable steps to protect your information. Although no data transmission over the Internet or information storage technology can be guaranteed to be 100% secure, we employ a variety of proven security practices to achieve the highest level of security possible. These practices include, but are not limited to:
- Restricting server access
- Utilizing strong passwords at all times
- Incorporating various data encryption methods to ensure that all user data is kept secure and confidential
- Establishing policy to never disclose, sell or in any way release user information.
We also take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.
We restrict access to personal information to clearTXT employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
6. clearTXT Privacy Policy Statement Changes
If clearTXT changes this privacy statement, we will post those changes will be posted on the Privacy Policy page on the clearTXT website, so that you will always know what information we gather, how we might use that information, and whether we will disclose it to anyone. By using clearTXT Services, you signify your assent to the clearTXT Privacy Policy Statement. If you do not agree to this statement, please do not use the clearTXT Services. Your continued use of clearTXT Services following the posting of changes to these terms will mean you accept those changes.
7. No SPAM Policy & Code of Conduct
clearTXT is dedicated to protecting users from receiving unwanted text messages and emails (“Spam”). We will not send you unwanted advertising text messages or emails. clearTXT is an opt-in based service. In addition, we have taken the additional steps of providing recipients with advanced notification management services specifically designed to prevent spam, including selection of Topics of Interest, Do Not Disturb Times, and the ability to specify the number of messages to receive. Users decide if and when to receive notification on their cell phones and/or inboxes.
clearTXT will not tolerate any of its partners sending Spam to any registered clearTXT users and will terminate partners’ Services should that partner send Spam to registered clearTXT users. Please see our complete Code of Conduct.
